1. Acceptance of Terms. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Promptims ("Promptims," "we," "us," or "our"), the operator of the Promptims platform accessible at promptims.com and any associated applications or services (collectively, the "Service"). By accessing, registering for, or using Promptims in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the Service.

2. Eligibility. You must be at least 18 years of age to use Promptims. By registering, you represent and warrant that you are 18 years of age or older. We reserve the right to terminate accounts belonging to users we reasonably believe are under the age of 18 without prior notice. Promptims bears no responsibility or liability for any content created, posted, or shared by users who have misrepresented their age.

3. Account Registration. To create, edit, save, or publish content on Promptims, you must register for an account. When you register, you agree to provide accurate, current, and complete information; to keep your login credentials confidential and not share them with any third party; to notify us immediately at support@promptims.com if you suspect unauthorized access to your account; and to be solely responsible for all activity that occurs under your account. By signing in, you agree to receive transactional emails related to your account and marketing emails from Promptims. You may opt out of marketing emails at any time by clicking the unsubscribe link included in every marketing email.

4. User-Generated Content and Ownership. Promptims allows you to create, upload, publish, edit, and delete prompts, descriptions, tags, and other content ("Content"). You are solely responsible for the Content you submit and represent that you have the right to submit the Content, that the Content does not infringe any third-party intellectual property, privacy, or other rights, and that the Content is not illegal, harmful, defamatory, or in violation of these Terms. All Content you submit to Promptims, including but not limited to prompts, titles, descriptions, and tags, is owned by and belongs to Promptims upon submission. By submitting Content, you irrevocably assign and transfer to Promptims all rights, title, and interest in and to such Content, including all intellectual property rights, worldwide, in perpetuity, without compensation to you unless separately agreed in writing. Promptims has the full right and permission to use, reproduce, modify, adapt, publish, translate, distribute, sublicense, display, perform, and exploit your Content in any manner and for any purpose, commercial or otherwise, without any further notice or consent from you. Your display name will be publicly shown on every prompt and interaction you publish on Promptims. Promptims reserves the right, but not the obligation, to review, remove, edit, or disable access to any Content at our sole discretion, without prior notice, for any reason including but not limited to violation of these Terms or applicable law.

5. Acceptable Use. You agree not to use Promptims to post Content that is illegal, obscene, defamatory, threatening, harassing, abusive, or that promotes discrimination, violence, or hatred of any kind; to infringe or misappropriate any intellectual property rights of Promptims or any third party; to distribute malware, spyware, phishing content, or other harmful or malicious code or instructions; to attempt to gain unauthorized access to any part of the Service, other users' accounts, or our infrastructure; to scrape, crawl, or use automated means to access or collect data from Promptims without our prior written consent; to impersonate any person or entity or falsely represent your affiliation with any person or entity; to use the Service for any illegal purpose or in violation of any applicable law or regulation; or to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service. Violation of this section may result in immediate account suspension or termination without notice. Promptims bears no responsibility or liability for any Content posted by users, including content that is offensive, harmful, inaccurate, or otherwise objectionable.

6. Account Deletion. You may request deletion of your account at any time by contacting us at support@promptims.com. Upon deletion, your account, display name, email address, and all prompts and Content you have published will be permanently deleted within approximately 30 days. Certain data may be retained for a limited period where required by law or for legitimate business purposes. Deletion is irreversible and we cannot recover deleted accounts or Content.

7. Email Communications. By creating an account, you agree to receive transactional emails necessary for account operation including login links, security alerts, and support responses, which cannot be opted out of while your account is active, and marketing emails including promotional messages, feature announcements, and community updates from Promptims, from which you may opt out at any time by clicking the unsubscribe link in any such email or by contacting support@promptims.com.

8. Intellectual Property of Promptims. The Promptims name, logo, platform design, software, and all technology underlying the Service are owned by or licensed to Promptims and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose. You may not copy, reproduce, modify, reverse-engineer, distribute, or create derivative works of any Promptims intellectual property without our prior written consent.

9. Pricing and Payments. Promptims is currently offered free of charge. We reserve the right to introduce paid features, subscriptions, or other monetization at any time with advance notice to registered users. Any such paid features will be subject to additional terms presented to you before purchase.

10. Disclaimer of Warranties. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PROMPTIMS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS. YOU USE THE SERVICE AT YOUR OWN RISK. ANY CONTENT, PROMPTS, OR AI WORKFLOWS SHARED ON PROMPTIMS ARE USER-GENERATED AND PROMPTIMS MAKES NO REPRESENTATIONS REGARDING THEIR ACCURACY, LEGALITY, QUALITY, OR FITNESS FOR ANY PURPOSE. PROMPTIMS EXPRESSLY DISCLAIMS ALL LIABILITY FOR USER-GENERATED CONTENT INCLUDING CONTENT THAT IS OFFENSIVE, HARMFUL, INACCURATE, SEXUAL, DEFAMATORY, OR OTHERWISE OBJECTIONABLE.

11. Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROMPTIMS, ITS OPERATORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING DAMAGES ARISING FROM USER-GENERATED CONTENT, EVEN IF PROMPTIMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PROMPTIMS'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED FIFTY ISRAELI NEW SHEKELS (₪50).

12. Indemnification. You agree to indemnify, defend, and hold harmless Promptims and its operators, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses including reasonable legal fees arising out of or in connection with your use of the Service, your Content, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

13. Third-Party Services. Promptims integrates or relies on third-party services including GitHub for authentication, Neon for database hosting, and Vercel for hosting and analytics. Your use of these services is subject to their respective terms of service and privacy policies. Promptims is not responsible for the practices of any third-party service.

14. Termination. Promptims reserves the right, at its sole discretion, to suspend or terminate your account and access to the Service at any time and for any reason, including violation of these Terms, without prior notice or liability. Upon termination, your right to use the Service ceases immediately. Sections 4, 10, 11, 12, and 15 of these Terms survive termination.

15. Governing Law and Dispute Resolution. These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in Israel.

16. Changes to These Terms. Promptims may revise these Terms at any time. When we make material changes, we will update the last updated date at the top of this page and notify registered users via email or a prominent in-app notice. Your continued use of the Service following notice of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may request account deletion as described in Section 6.

17. Miscellaneous. These Terms together with the Privacy Policy constitute the entire agreement between you and Promptims regarding the Service and supersede all prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Failure by Promptims to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. You may not assign or transfer any rights or obligations under these Terms without Promptims's prior written consent. Promptims may assign its rights and obligations freely.
